Private Event Space Request Form

Assumption of Risk, Release and Waiver Liability and Cancellation Policy
Agreement made between Island View Golf Club, a non-profit corporation of the State of Minnesota, at Waconia, Minnesota, herein called the Club and the Group (represented by the acknowledgement and completed form below) herein called the Group.
CANCELLATION POLICY:  In the event this reservation is canceled by the Group, the Group agrees that the Club will have lost the opportunity to offer our event space to others and will incur additional costs in attempting to book our services for the date reserved for your event.  The Group agrees that the exact amount of our damage will be difficult to determine.  The Group agrees that the liquidated damages clause in this agreement is a reasonable effort by the Group and the Club to agree in advance on the damages that we will suffer due to a cancellation.  Therefore, the Group agrees that should the Group cancel the event for any reason, the Group will pay as liquidated damages to the Club immediately upon notice of cancellation the following percentage of the total amount of our services for your event as follows:
A.) Notice of cancellation received more than 180 days prior to event will result in a refund of 25% of the Group’s total room rental.
B.) The Group’s room rental payment is 100% transferable to another date based on the Club’s availability.
C.) Notice of cancellation less than 180 days prior to contracted date will result in a refund of 0% of the total room rental.
In providing notice of cancellation, the Group must provide a written notice via letter or e-mail.  The refund you are entitled to based on the aforementioned cancellation policy will be mailed to you within thirty (30) business days.
DAMAGE:  The Group shall be held liable for all damages to the Club facilities, grounds, and other properties caused by the Group’s use of the Club.  The Club is not responsible or liable for loss or damage to personal belongings or property of persons attending the Event.
RELEASE AND HOLD HARMLESS:  The Group hereby and forever discharges and releases the Club, its successors, assigns, directors, officers, or employees, from all claims, demands, damages, actions and causes of action whatsoever, which it or its members, employees, agents or guests may now have or may hereafter have, because of the Group’s planned use of the Club facilities.  The Group shall hold the Club, its directors, officers or employees harmless and shall indemnify them from and against all liability for injuries to or deaths of persons or damage to property arising from activities under this agreement.
FOOD AND BEVERAGE:  Only food and beverages provided by Vandy’s Grille shall be consumed on the golf course, clubhouse, or other Club facilities.  The Club reserves the right to confiscate all food and beverages violating this policy, unless agreed upon beforehand.  Vandy’s Grille is a separate business from Island View Golf Club and will provide the Group a separate contract outlining deposit requirements for all Food and Beverage orders and due dates of when menu items must be selected by, if your reservation requires Food and Beverage services.
